After the Hamas attack that killed more than 1,300 Israelis on Oct. 7, many Americans were indignant to see academic and left-wing organizations issuing statements that excused or implicitly endorsed the massacre. Such sentiments are not surprising, however, to anyone who follows the way Israel and Palestine have long been discussed in those quarters. An idea widely accepted in a small ideological community has now been exposed to the view of the general public, revealing the deep estrangement between them. The idea in this case is “settler colonialism,” a term that appears often in the pro-Hamas statements collected by the Anti-Defamation League. Mondoweiss, an anti-Israel online publication, has called the Hamas attack “part of the Palestinians’ century-long struggle for liberation” from “Zionist/Israeli settler colonialism.”

We watched the marketing of a massacre. Much has been written and spoken about some progressive groups and many progressive students (and faculty members) at American colleges, who reacted to the hunting, the shooting, the slashing, the burning of all those people in Israel by blaming … Israel. Student radicals have been targets of condemnation since at least the early 1960s, when they experimented with new forms of protest against anti-Black racism, the Vietnam War, poverty and censorship. “I think they oughta shoot ‘em if they’re carrying the Vietcong flag,” actor John Wayne said of the protests. In the 1960s, student radicals occasionally waved the Viet Cong flag to show solidarity with the people of Vietnam. But students did have the power to disrupt, to grab camera time and to create the iconic imagery of an era. You may hate these student activists’ words and actions, but they’re not the ones with the power here.

The preventive approach to domestic terrorism goes back even further than the 1990s and it begins with the basic police work and surveillance of the joint terrorism task forces. In fact, there is no section of the U.S. Criminal Code that criminalizes domestic terrorism as such. The absence of clear law around domestic terrorism, and the imperatives of prevention, mean that investigators and prosecutors who work domestic terrorism cases must focus on more common charges: weapons violations, illegal drug possession, burglary, aiding and abetting and so forth. But this was not enough to overrule the fear of domestic terrorism that was gripping the nation and that hung in the courtroom. It reflected the legal paradoxes of the case and domestic terrorism law in general or, maybe more accurately, the absence of it.
